DRAFT - pending legal review
Terms of Service
Last updated: November 5, 2026
These terms apply when you buy services or software from {{LEGAL_NAME}}, doing business as Digital Advance ("we" or "us"). "You" means the business that buys them.
1. Signed agreements come first
If you and we have signed an agreement, that agreement prevails over these terms wherever the two differ. These terms cover anything it doesn't address.
2. What we provide
We provide digital marketing services for dry cleaners and laundries in the United States, including Google Ads management, local SEO and Google listings, websites and landing pages, social media management, CRM setup and automation, review management, business intelligence and, on request, customer retention. We also provide AI Manager Assistant, a subscription analytics software. Your agreement or order states which of these you are buying.
We serve businesses in the United States. We don't sell to consumers.
3. Term and renewal
Services and subscriptions run month-to-month and renew automatically each month until canceled, unless a signed agreement says otherwise.
4. Cancellation
Marketing management: you can cancel with 30 days' written notice, unless a signed agreement says otherwise.
Software: you can cancel anytime. Access continues until the end of the paid month.
Our refund and cancellation policy forms part of these terms.
5. Fees and taxes
Fees are stated in US dollars and don't include applicable taxes, which we add where required. We bill the amount in your agreement on the agreed day each month. Payments are processed by Stripe under its own terms.
The price of AI Manager Assistant is per store, per month. A store is a location open to the public. Delivery routes and lockers are included.
6. Advertising spend
Ad spend is separate from our management fee. Depending on your agreement, you pay the ad platform directly or it appears as a separate line on your invoice. You remain responsible for ad spend you approved.
7. No guarantee of results
We don't guarantee search positions, numbers of customers, revenue or return on investment. Results depend on many factors outside our control, including competitors, search engines and ad platforms, and your own operations.
8. Your responsibilities
- Give us the access to accounts, data and information we need to do the work.
- Make sure the information you give us is accurate and that you're allowed to share it.
- Obtain the consent required from your customers and contacts before we send email or SMS on your behalf or process their contact details.
- Review and promptly tell us about anything in our work that is inaccurate.
9. Accounts and materials
Ad accounts, Google listings and your domain stay in your name and belong to you. Your data and your brand materials remain yours, and you give us permission to use them to provide the services.
Once you have paid for them, the campaign content and pages we create for you are yours to keep using. We keep ownership of our software, our tools and our general methods.
10. Software and demo access
Use of AI Manager Assistant with your data requires a signed data agreement. It works today with the SMRT POS. The AI features read your data and don't change anything in your POS or CRM.
Demo access is temporary, is limited to a fictitious business and can be ended by us at any time. The demo account is shared with other visitors, so don't enter real data into it.
11. Acceptable use
- Don't use our services or software for anything illegal, deceptive or that infringes the rights of others.
- Don't ask us to publish false reviews, false claims or anything that breaks the rules of an advertising platform.
- Don't try to access another account's data, or interfere with or reverse engineer the software.
- We may suspend services that break these rules.
12. Disclaimer
Except as stated in these terms or a signed agreement, the services and software are provided as is, without warranties of any kind, to the extent the law allows. Answers from AI features can contain errors, and you should check any figure before relying on it for an important decision.
13. Limit of liability
To the extent the law allows, neither party is liable for indirect or consequential damages or lost profits, and each party's total liability under these terms is limited to the fees you paid us in the three months before the claim arose.
14. Governing law
These terms are governed by the laws of {{GOVERNING_LAW}}.
15. Changes
We may update these terms. We'll post the new version here with its date and give notice of material changes to active customers. Changes don't apply to a month you have already paid for.
